1. Acceptance of Terms

By accessing or using OrderAtlas ("the Service"), operated by OrderAtlas ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

OrderAtlas provides a REST API that enables programmatic order placement, shipment tracking, and fulfillment management on supported online retail platforms. The Service operates on a prepaid credit model — you purchase credits and consume them when performing API actions.

3. Account & BYOA Model

You are responsible for maintaining the confidentiality of your OrderAtlas account credentials and API keys. The Service uses a "Bring Your Own Account" (BYOA) model — you provide your own retail platform account credentials to place orders. You represent and warrant that:

• You are the authorized owner of any platform accounts you use with the Service.
• Your use of third-party platform accounts complies with those platforms' terms of service.
• You will not use the Service for any unlawful, fraudulent, or abusive purpose.

We do not store your platform credentials permanently. They are used only for the duration of the session and then discarded.

4. Credits & Payments

• Credits are purchased via Stripe and are non-refundable once delivered to your account.
• Credits do not expire.
• Each API action (order placement, import, tracking conversion) consumes a fixed number of credits as displayed on the pricing page at the time of purchase.
• We reserve the right to adjust credit pricing for future purchases. Existing credit balances are not affected by pricing changes.
• Chargebacks or payment disputes may result in immediate account suspension and forfeiture of remaining credits.

5. API Usage & Rate Limits

You agree to use the API within the published rate limits (default: 60 requests per minute). Exceeding rate limits may result in temporary throttling. Abuse of the API — including excessive requests, automated scraping of our documentation, or denial-of-service attempts — may result in permanent account termination.

6. Prohibited Uses

You may not use the Service to:

• Place fraudulent orders or engage in any form of financial fraud.
• Violate the terms of service of any third-party platform.
• Engage in carding, identity theft, or use stolen payment methods.
• Resell, sublicense, or redistribute access to the API without written consent.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Circumvent rate limits, authentication, or any security measures.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT ORDERS WILL BE SUCCESSFULLY PLACED, THAT TRACKING INFORMATION WILL BE ACCURATE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

We are not responsible for actions taken by third-party platforms, including but not limited to order cancellations, account suspensions, payment issues, or changes to their services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORDERATLAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for credits in the 30 days preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless OrderAtlas, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Any remaining credits are forfeited upon termination for cause (e.g., violation of these Terms).

11. Changes to Terms

We may update these Terms at any time. Changes take effect when posted on this page. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
